Please read the following terms and conditions carefully before ordering products or services from us. By purchasing products or services from us, you agree to these terms of sale. These terms do not replace or affect your statutory rights. In these terms, "you" and "your" refer to the customer and "we", "us" and "our" refer to CD-REPAIR / CDF ENTERPRISE
1. Order Acceptance
1.1 Only once we have received cleared funds
for the product(s) and or service(s) and a confirmation email is sent to
you, will a contract for the sale of product(s) OR
service(S) you order from us be created.
1.2 We will not be legally bound by any factual or typographical errors on the website or other promotional materials.
2. Liability and Disclaimer
To fullest extent permitted at law and except in respect of death and personal injury caused by negligence on our part or on the part of our employees we shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty condition or other term or any duty at common law or under express terms of the contract for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by negligence on our part or the part of our employees or agents or otherwise) which arise from or in connection with the use of the website, the supply of goods, incoming or return transit of goods, the repair of goods or their use or resale by you, and our entire liability under or in connection with the contract shall not exceed the price of the goods or repair, except expressly provided in these conditions. This does not affect your statutory rights.
We will strive to repair all your discs supplied under the REPAIR SERVICE. This service employs proven methods and machinery that have a 97% success rate. In the event of a disc being deemed to be beyond repair, we will issue a credit for the repair cost. Any discs passed through the repair process, are chargeable, only discs we deem non repairable will not pass through the repair process and a credit will be issued.
Discs are repaired to as close to 'as new' condition without scratches to the underside of the disc as possible. All discs repaired are to be considered used and condition of such reflected. Any wear or damage previously occurring to the top, label sides, of discs will remain.
Substantial damage to any discs will often require several repairs. Such subsequent repairs incur further costs. If further repairs are necessary, we contact you by email or phone, if supplied, and will only carry out further repairs upon your approval.
Some wear on the circular label of a any double sided DVD discs may occur
during the repair process. We contact you by email or phone, if supplied,
upon receipt of any double sided DVD discs and will only repair these
discs upon your approval. Some slight signs of wear may show on the centre
hub of any disc we repair.
We cannot undertake to repair any warped, cracked, broken or perforated disks.
Any discs sent
under the BUFF & POLISH service will only have the surfaces refinished and
no work will be carried out to remove any damage below the uppermost
surface of the polycarbonate layer. Therefore discs with unreadable data
will not be repaired using this process.
It is the customer's responsibility to insure any discs sent to or returned from CD-REPAIR.CO.UK.
CD-REPAIR.CO.UK accept no
liability for disc(s) lost or damaged in transit to us or return transit
to the customer. Discs will be deemed to be lost in transit by Royal Mail
once fifteen working days has elapsed from the date of despatch.
Unfortunately we can't guarantee that our repairs will be successful. We also cannot be held responsible or liable for any consequential damage or loss due to our repair process
or use of our services. In all cases, our liability will be limited to the price the disc repair.
Mailers sent out by us include pre-paid postage only. No insurance cover or signature on receipt is provided. Insurance and or Compensation is the responsibility of the owner of any disc(s) sent to CD-REPAIR.CO.UK for repair.
We strongly recommend sending discs to us using Recorded Delivery and requesting Return Recorded Delivery Option.
Mailers and material contained within remain the property of CD-REPAIR.CO.UK.
Therefore, we reserve the right to impose a fee for mailerís not returned to us within 90days.
Please Do Not Send Cases with Discs. We can not return cases sent to us with discs. A postage and administration charge will be issued if cases are requested to be returned to the customer.
Return postage from CD-REPAIR.CO.UK to the customer, carries a maximum of £41 compensation cover, provided at Royal Mail's discretion, as standard. Compensation will be reflected as ten times the amount of a First Class stamp for disc sent First Class or ten times the cost of a Second Class stamp for discs sent Second Class. Enhanced insurance can be added at the point of purchase at the buyers expense, this carries a maximum £500 compensation cover. Return Recorded Delivery will be provided at no extra cost for three or more discs, applicable to discs received by us under full price repair with no promotional offers, bulk rate discs will be covered by return Recorded Delivery free of additional charge. Recorded Delivery for one or two discs sent must be added for an additional fee to obtain return Recorded Delivery. Any subsequent claim for compensation for loss or damage during return transit will be awarded at the discretion of Royal Mail. We can not be held responsible for the pursuit of any such claim. The title of ownership of the goods remains, therefore it is the title owners responsibility to insure any discs sent to us adequately.
Payment must be received with orders if payment is made by post. Alternatively, payments must be made prior to CD-REPAIR.CO.UK receiving discs for repair, using our online ordering section of the CD-REPAIR.CO.UK website.
Orders cannot be processed without payment. Any outstanding balances not paid within 10 days of our receipt of discs will be charged for at the full rate of 3.99 per disc. Special offers and bulk discounts will be revoked.
Any special offers, customer bonuses or offer of any kind issued by way of a voucher or card by us is to be used on a one per order basis and can not be used in conjunction with any other offer. Any free disc offers can only be used when paying for a minimum of one additional disc repair. Offer vouchers are not transferable and are deemed invalid 90 days after their issue. No offers, vouchers or scheme can be used as full payment for any order. We reserve the right to not fulfil unfair usage of any offers.
In the event of any refund
being processed to the customer, any refund will be the total amount paid
by the customer less a small administration charge which reflects fees
that have been incurred by the payment transaction. Bulk, discounted
invoiced repairs carry a 3% surcharge if paying by PayPal. Discounted
rates can not absorb these transaction costs. All website payments include
any transaction charges.
CD-REPAIR.CO.UK repair and return discs within 7
working days, some delays are possible therefore this time frame be
extended and is not guaranteed..
CD-REPAIR.CO.UK cannot be held responsible for any consequential damage or loss caused as a result of repairs carried out or attempted to be carried out or from a total loss of discs either at CD-REPAIR.CO.UK premises or in transit to or from CD-REPAIR.CO.UK premises.
CD-REPAIR.CO.UK reserve the right to alter or vary these Terms and Conditions at any time.
We pride ourselves in ensuring that all your
details are kept safe & secure. You may at anytime request to be removed
from our database and or stop any form of advertising by us such as
emails. All details about you are completely secure.
At CD-REPAIR.CO.UK we recognise our customer's privacy and as such we will only use the information you give us to process your order and to provide you with the best possible service. We do not sell mailing lists to other companies, nor do we divulge any of your personal details to any other companies or individuals. All your personal details are stored and processed on our secure server.
Data Protection Act 1998
CD-REPAIR.CO.UK supports all aspects and requirements of the Data Protection Act of 1998 and will always work within an environment which has full compliance with the "Act".
Please help CD-REPAIR.CO.UK keep your records current by notifying us of any changes to your personal details by updating your account or by emailing us.
At CD-REPAIR.CO.UK, information about our customers is an important and integral part of our company, and we are not in the business of selling this information to others.
4. Force Majeure
We reserve the right to delay delivery or to cancel the order or reduce the volume of the goods ordered by you (without any liability to you) if we are prevented from or delayed in the carrying on of our business due to circumstances beyond our reasonable control including without limitation acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock out, strikes or other labour disputes (whether or not relating to either party's work force), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials Provided that if the event in question continues for a continuous period in excess of 14 days, you shall be entitled to give us notice in writing to terminate the order.
By sending discs to CD-REPAIR.CO.UK for repair you are agreeing to our Terms & Conditions.
These terms and conditions cannot be varied except in writing signed by an authorised person at CD-REPAIR.CO.UK
8. Governing Law and Jurisdiction
This Agreement will be governed by and construed in accordance with English law.
